Insider Guide to Workers' Compensation

Despite everyone's best intentions, work-related injuries can (and do) happen. When these injuries occur, the injured employees are entitled to financial compensation for medical expenses and lost wages. The insurance that provides this compensation is commonly known as "workers' compensation" or "workman's comp."

Workers' compensation is very important to business owners and employees alike. As your trusted business attorney at the Lake of the Ozarks, Deirdre O'Donnell with O'Donnell Law Center in Osage Beach is here to help you make sense of this type of insurance.

Workman's Comp: An Overview

Workman's comp is essentially a form of insurance that employers purchase in order to cover their employees in the event of a work-related injury. Workers' compensation compensates injured employees by paying for the costs related to their injury. The benefits typically covered include:
  • Medical Expenses
  • Physical Therapy
  • Retraining
  • Compensation for Permanent Injuries
  • Disability Payments (generally about two-thirds of the usual salary)
  • Benefits to Survivors of Workers Killed on the Job
Exact benefits of workers' compensation vary based on the type of injury, the severity of the injury, and the situation in which the injury occurred. Because of these variables, workers' compensation can seem very complex. If you have questions about workman's comp, it's a good idea to consult an experienced business attorney.

Workman's Comp: FAQ

Specific answers to your questions will depend on your unique situation, but here is the basic response to a few frequently asked questions about workers' compensation.

Can I be fired or punished for filing for workers' compensation?
In short, no. Once employers have a certain number of employees, they are required to provide workers' compensation to employees who are injured on the job. In Missouri, that number of employees depends upon the type of industry your business is in.

Is everyone guaranteed worker's comp benefits?
No. Most employees qualify for the benefits, but Missouri law excludes some individuals. Examples of these exclusions include seasonal employees, domestic employees, and volunteers.

Can I sue my employer for a work-related injury?
There are always exceptions, but generally, no, you may not sue an employer who's work place is covered by workers' compensation insurance. Having said that, you should always consult an experiences worker's comp attorney to see if any of the exceptions apply to your situation.

Estate Planning & Probate Administration

The terms "estate planning" and "probate" or "probate administration" have to do with designating what will happen to your assets and belongings after you pass. As your experienced family attorney in Osage Beach, Deirdre O'Donnell is here to make sense of estate planning and probate administration at the Lake of the Ozarks.

Estate Planning at the Lake of the Ozarks

Estate planning is exactly what it sounds like - planning your estate. It is the process of organizing your property and financial assets to determine who they will go to after you pass. Wills and trusts are documents that provide this information. Planning your estate ahead of time is a fairly simple process, but it saves lots of time energy for your heirs after you are gone.

Your physical belongings are not the only things to be attended to after you pass. If you have children under the age of eighteen, you will also need to recommend a new legal guardian for them if something should happen to you.

No, you're not too young (or too poor) to have a will. Everyone should take the time to set up their estate. You may not have millions, but the assets that you do possess will have to go somewhere after you pass. What happens to your house? Your car? Your children? Your IRA?  These are all issues that may be addressed in your will.

Probate Administration at the Lake of the Ozarks

Probate administration is the second half of the equation. It refers to the court process of following the instructions you left in your will and distributing your assets to the heirs you specified. You can appoint a representative in your will, (called a personal representative or executor), to be in charge of carrying out these instructions, or if you don't, the probate court may designate someone.

Meet Attorney Deirdre O'Donnell!

Positive and genuine client relationships are our number one priority at O'Donnell Law Center. We truly care about getting to know our clients so we can provide them with the best possible legal services at the Lake of the Ozarks. We recognize that strong relationships are a two-way street, though, so this week we're dedicating our blog to helping you get to know the Lake of the Ozarks' top attorney, Ms. Deirdre O'Donnell.

Getting to Know Deirdre!

I was born in St. Louis, Missouri on February 22, 1962. I graduated from Pattonville High School in St. Louis County and went on to earn a BA from Washington University in St. Louis, a Master's Degree in Social Work from Washington University and a Juris Doctorate Degree from Washington University School of Law. By 1996, I was licensed to practice law in the state of Missouri.

In my young adult years, I played keyboard and performed in various St. Louis venues in a contemporary jazz band. I later worked as a social worker, where I learned valuable organizational, listening, and problem solving techniques that serve my legal practice well. Open and frequent communication with my clients are integral components of my law practice in Osage Beach.

Deirdre and her husband, Bob
After I became a lawyer, I first worked as an assistant public defender with the Missouri State Public Defender's System, serving the Camden County, Lake of the Ozarks area. I entered the private practice of law in 1998, when I joined the Law Firm of Phillips, McElyea, Carpenter, & Welch, P.C. as an Associate. I became a shareholder of the firm in 2000 and remained there until July 31, 2014.

On August 1, 2014, with the help and support my family and friends, I finally launched my own firm: O'Donnell Law Center. I feel like I have been preparing for this my entire life. Our Center's business model is based upon cutting edge technology, efficiency, customer service, and building life-long relationships.

My husband, Bob, and I have two sons, Michael and Jared. Michael has begun a career as a scientist. Jared is in the eighth grade and currently enjoys track, basketball, acoustic guitar, and computer games. I also recently began learning to play the acoustic guitar, and I can't get enough of it! We share our household with a beautiful German Short Hair Pointer named Lady.

Bob and I enjoy taking scenic day trips on our Harley, growing flowers and vegetables in our raised-bed garden, challenging ourselves with cooking and eating new foods, tackling home improvement projects, and squeezing that last mile out of our all-electric car.

I believe in treating people with respect and integrity. If you're looking for quality legal representation at the Lake of the Ozarks, I hope you'll stop by and see me. I look forward to getting to know you!
